These Terms & Conditions ("Agreement") apply to all services provided by Toby's Photography LLC ("Photographer") to real estate agents, brokers, property owners, and any other clients ("Client"). By booking, scheduling, or receiving services, the Client agrees to these terms.
1. Services Provided
Toby's Photography LLC provides real estate media services including, but not limited to:
Photography
Videography
Aerial/drone imagery
Floor plans
3D tours
Virtual twilights
Real twilights
Marketing materials
Services include only what is explicitly listed in the Client's order.
2. Scheduling & Access
The Client is responsible for ensuring the property is ready at the scheduled time.
Photographer is not responsible for cleaning, staging, organizing, or moving personal items.
If the property is inaccessible upon arrival (locked, unsafe, wrong address, etc.), Photographer may reschedule at the earliest available time but makes no guarantee of same-day service.
3. Turnaround Times
Standard delivery times vary by service type.
Photographer will make reasonable efforts to deliver media promptly but does not guarantee delivery by a specific time unless agreed to in writing.
4. Rights & Licensing
Photographer retains full copyright to all images, video, and media created.
Client receives a non-exclusive, non-transferable license for real estate marketing and MLS-related uses for the duration that the Client is the listing agent.
Media may not be transferred, sold, given, or licensed to third parties (including other agents, builders, stagers, or homeowners) without written permission.
Additional licensing (e.g., for builders, designers, long-term/non-MLS usage) requires separate permission.
5. Additional Fees
Toby's Photography LLC will not add extra fees, surcharges, penalties, or unexpected costs except for traveling fees.
The Client will never owe additional charges for:
Cancellations
Rescheduling
Weather delays
Property access issues.
Toby's Photography LLC will however charge travel fees if deemed necessary.
6. Weather
For outdoor and aerial work, Photographer may reschedule if weather conditions pose safety concerns or prevent quality results (rain, high winds, storms).
Client will not be charged any additional fees for rescheduling due to weather.
7. Drone Operations
Drone services comply with FAA Part 107 regulations.
Photographer will not fly in:
restricted airspace without authorization
unsafe environments
severe weather
areas obstructed by trees, power lines, animals, or people
8. Property Condition & Safety
Client is responsible for ensuring the property is safe for Photographer to enter and work in.
Photographer may refuse to shoot if the property presents safety hazards.
9. Liability & Limitations
To the fullest extent permitted by Maryland law:
Photographer is not liable for any property damage unless caused directly by the Photographer's proven negligence.
Photographer is not responsible for:
injuries to homeowners, occupants, pets, or third parties
In any claim, Photographer's total liability shall not exceed the total amount paid for the services in question.
10. Refunds
Due to the nature of digital media, all delivered media is non-refundable once sent to the Client.
If Photographer is unable to complete a shoot due to personal emergency, environmental reason, or technical failure, Photographer will offer:
rescheduling at no cost, or
a full refund for undelivered services
11. Model & Property Release
The Client confirms they have the authority and permission from the property owner or authorized representative to allow photography, videography, and drone operations.
The Client agrees to indemnify Photographer against claims regarding:
privacy violations
homeowner disputes
unapproved media capture
12. Editing & Revisions
Basic editing is included.
Revisions for errors made by Photographer are free.
Creative re-edits or stylistic changes may require additional time, and may incur additional fees to the Client.
13. Use of Media for Portfolio
Photographer may use images and video for:
portfolio
social media
website
marketing
Unless the Client explicitly requests in writing that the media remain private.
14. Digital Media Measurement Accuracy
Any digital media provided by Toby's Photography LLC that includes measurements is not guaranteed to be accurate on any basis.
15. Agreement
By booking a session or receiving delivered media, the Client acknowledges and agrees to these Terms & Conditions.
